Cardmaku Terms of Service
Notice
This is the Cardmaku Terms of Service for the free open public beta (version free-open-beta-v1). Effective when this version is published on Cardmaku. It is published as a notice. Using Cardmaku is not treated as agreement to it, and no acceptance is recorded.
1. Introduction and scope
Cardmaku helps you organize cards you already hold, understand their benefits, and consider how those benefits may relate to a trip. These terms cover the free Cardmaku service offered in Taiwan, Japan and the United States. Cardmaku is in open public beta, and all information in Cardmaku is free. Its purpose is to help people organize their wallets and plan travel. These terms do not offer a paid plan, an insurance policy or a travel-product purchase. Cardmaku does not promise coverage, savings, advice or any decision by an issuer, insurer or provider, and the official terms of the card issuer or benefit provider control the underlying benefit.
Cardmaku is operated by Noena LLC, a California company. In these terms, “we” means Noena LLC. Any term that limits your rights or depends on your agreement applies to you only where you have actually agreed to it or applicable law otherwise makes it binding. Cardmaku does not treat use of the service, silence or the publication of these terms as your agreement.
2. Accounts and security
Use accurate account details and keep information you rely on for benefit checks up to date. Protect your sign-in credentials and the email or other sign-in method associated with your account. Do not share credentials with someone who should not have access to your wallet, household or trips.
If you suspect unauthorized access, contact us using section 13. Do not send passwords, authentication codes or complete payment-card numbers. An action recorded under your account is not, by itself, proof that you authorized it; account concerns need to be assessed on their circumstances.
Cardmaku accounts are free and are for adults who are legally able to enter into a contract under the requirements that apply where they live. Do not create an account for a child. A child can appear as a traveller record inside an adult's household (see section 7), which is separate from an account.
3. Informational service and source verification
Cardmaku presents organizational tools, benefit information and trip-related checks, not a decision by an issuer, insurer, border authority or benefit provider. A card in your wallet does not establish that every listed benefit applies to you or to everyone travelling with you.
Before acting, check the current official source and the conditions relevant to your situation. These can include the exact card product, residence, traveller relationship, trip dates, payment method, enrollment, limits, exclusions and claim deadlines. A source link or recorded check helps you investigate; it does not certify that information is complete or current.
An unknown coverage result means the information is unresolved, not that you are eligible or definitely uncovered. A club membership is not insurance. An estimated or potential benefit value is not money or value you have received. A reminder, status label or completed checklist is not proof of enrollment, coverage, reimbursement or permission to enter a country.
The applicable issuer, policy and provider terms determine the underlying benefit; Cardmaku's summary does not replace them. If a summary conflicts with those terms, check with the responsible provider before relying on the benefit. Travel-entry decisions remain with the relevant authorities.
Cardmaku is not an emergency service. For urgent assistance, use the appropriate local emergency service or your provider's assistance channel. Do not use a Cardmaku support request in place of an insurance claim or a time-sensitive notice to a provider.
4. Third-party information and destinations
Cardmaku may direct you to official sources or other external services. Those destinations have their own information, terms and privacy practices. A link or the display of a card or provider name does not mean that the provider endorses Cardmaku, that Cardmaku endorses every offering there, or that a partnership exists.
Check whom you are dealing with before sharing information or entering a separate agreement. These terms do not authorize Cardmaku to open financial accounts, enroll you in benefits, buy products or submit claims on your behalf. Responsibility for Cardmaku's own conduct is not removed merely because third-party information is involved.
5. Acceptable use
Use Cardmaku lawfully and respect other people's privacy and rights. In particular, do not:
- Access or try to access another person's account, household or trip records without authority.
- Impersonate someone or submit information you have no right to provide.
- Bypass access controls, introduce malicious software or deliberately disrupt service availability.
- Collect other users' personal information without permission or use the service to harass them.
- Present altered Cardmaku results as official evidence of coverage, eligibility or provider approval.
These restrictions do not remove rights or exceptions that applicable law protects, including lawful security research or interoperability activities where protected.
6. Cardmaku materials and your content
Cardmaku's software, presentation and original materials remain subject to their owners' intellectual-property rights. Card names, logos, source documents and other third-party materials belong to their respective owners. Access to Cardmaku is not a transfer of ownership in those materials. You may use the service's available functions to organize and consult your information, subject to these terms and applicable law.
You retain any rights you have in information or content you provide. You give us only the permission needed to receive, store, process and display it to provide the Cardmaku functions you use, including wallet organization and trip checks. Service providers may handle it for those same service purposes, as described in the Privacy Policy. This is not permission to publish private family or trip records, use them in advertising or acquire ownership of them.
That permission is limited by its purpose and duration; it is not a perpetual, unrestricted content license. Removing content or ending use ends permission for further active use of it to provide those functions. Removing an item does not necessarily remove every copy at once. A complete, verified retention schedule is not yet available; do not assume that inactivity or signing out erases information. The Privacy Policy describes what we currently know about how information is kept and removed.
7. Privacy and information about other people
The Privacy Policy explains how we handle account, wallet, household and trip information. These terms do not replace the Privacy Policy and do not supply blanket consent for unrelated processing.
Before adding another person's details, make sure you have the authority required to provide them for the relevant Cardmaku functions. Give that person the relevant privacy information and respect their choices and rights. Being the account holder does not make you the owner of another traveller's personal information. Include only information needed for the task.
You may add a traveller record for a child only if you are that child's parent or legal guardian, or otherwise hold legal authority to provide the child's information. A traveller record for a child is separate from an account and gives the child no account access.
8. Suspension and ending use
You may stop using Cardmaku at any time. If access creates a security risk, involves unlawful conduct or materially breaches these terms, we may restrict the affected access while addressing the issue. Restrictions should be proportionate. Where lawful and practicable, we will explain the reason and provide a way to raise a mistake; urgent protective action may need to come first.
Stopping use, signing out, removing a wallet item and deleting an account are different actions. Whole-account deletion is not currently available in the app, and deleting an individual item does not delete your whole account. To request account deletion, email the address in section 13. Sending an email requests handling of the matter; it does not automatically erase an account or any data. We do not promise a completion deadline, automatic erasure, backup deletion or vendor deletion. Rights you have under applicable privacy law remain available.
9. Changes to the service and these terms
Features and source information can change. A change to a benefit shown in Cardmaku does not itself change the issuer's or provider's agreement with you. Before we offer paid or materially different services, we will provide appropriate disclosures and obtain any agreement that applicable law or these terms require.
If we change these terms materially, the new version will have its own version identifier and take effect when it is published on Cardmaku. Where applicable law or the nature of the change requires your explicit agreement, we will ask for it and will not treat continued use or silence as your agreement. Changes will respect applicable notice and consumer-protection requirements.
10. Service limitations and disclaimers
Information can be incomplete, delayed or wrong, and service access can be interrupted. Cardmaku does not promise uninterrupted availability, an error-free check or a particular financial or travel outcome. Use official sources to resolve uncertainty rather than treating a summary as a guarantee.
These explanations do not exclude statutory guarantees or excuse duties that applicable law places on the operator. We do not adopt a general exclusion of all warranties.
11. Liability and mandatory rights
Nothing in these terms waives consumer or other statutory rights that cannot lawfully be waived, including applicable protections in Taiwan, Japan and the United States. The free nature of the service does not, by itself, eliminate the operator's legal responsibilities.
Nothing here limits liability that applicable law does not allow to be limited.
12. Questions and disputes
You may contact us to raise a concern and seek an explanation or correction. Contacting support is not a mandatory step before exercising a legal right, and does not replace a filing deadline or notice required by law.
These terms are governed by California law, subject to any consumer-protection rights that apply where you live and cannot be waived. These terms do not select an exclusive court or venue, require arbitration or impose a class-action waiver. Your applicable legal rights and available remedies are not reduced by these terms.
